Dubai will set up a court that will deal exclusively with property-related cases from September, a top judge of Dubai Courts said.
“The Property Court will be set up as per Law No1 of year 2003 under the main section of the court called The First Instance Court. It will have jurisdictions over all properties in Dubai except those of Dubai International Financial Centre, which has its own judiciary system,” Judge Mohammed Yousuf A Sulaiman, Deputy Director for Dubai Courts and Cassation Court’s Senior Judge, told Emirates Business in an exclusive interview.
“Under the directive of His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice-President and Prime Minister of the UAE and Ruler of Dubai, and following the success of the Labour Court, we are setting up another specialised court for all property related matters,” he said.
Judge Abdul Qadir Moosa, Chief of the Court of First Instance (Properties Court), will be in-charge of setting up the property court.
Currently, property-related cases are tried under the Civil Law. However, should any new law come into force within the jurisdiction of the property court, that law shall override the Civil Law for all property cases, the judge said.
The judgment passed in the property court can be challenged in the Appellate Court.
The property court will be set up with a minimum of ten judges.
The number could increase depending on the number of property related cases.
When asked about the pending property cases, Sulaiman said: “As of now, there is nothing pending with Dubai Courts relating to real estate issues.”
The Dubai Courts do not hear rental disputes, which are solely dealt by the Rent Committee of the Dubai Municipality, he said.
